Buy from a private individual — a neighbor, a family friend, a Marketplace seller — and Texas doesn’t just trust the number on your bill of sale. It taxes you on whichever is higher: your stated price, or 80% of the vehicle’s Standard Presumptive Value (SPV), a regional average the state publishes for every make and model.
Example: you pay $25,000 for a used truck privately. Its SPV is $34,000, so 80% of that is $27,200 — higher than what you paid. Texas taxes you on $27,200, not $25,000. You can look up your vehicle’s SPV at TxDMV.gov and enter it in the “Advanced” section above. If your car is genuinely worth less (damage, high mileage), a certified appraisal within 30 days can override the SPV figure.
Trade-Ins, Gifts and Even Trades: What’s Taxed Differently
- Dealer purchase with a trade-in: your trade-in value is subtracted before tax is calculated. Trade a $5,000 car against a $30,000 purchase, and you’re only taxed on $25,000.
- Still owe money on your trade-in? That doesn’t change your tax — Texas still credits the trade-in’s full value. But the payoff amount gets added to your new loan, so if you owe more than the trade is worth, that negative equity increases what you finance.
- Private-party purchase: no trade-in credit exists. The SPV rule applies regardless of what you traded.
- Gift between immediate family (spouse, parent/child, sibling, grandparent): a flat $10 transfer tax, not 6.25%.
- Even trade between two owners, no cash changing hands: a flat $5 transfer tax.
New Texas Residents: The $90 Flat Tax
Moving to Texas with a vehicle you already own and already paid tax on? You don’t pay 6.25% again. Texas charges a flat $90 new-resident use tax instead, as long as the vehicle was registered in your name in your previous state.
Title, Registration and County Fees, Explained
- Title fee: $28 in most counties, $33 in emissions-testing counties (Harris, Dallas, Tarrant, Travis, Collin, Denton, Fort Bend, and a few others). One-time, charged only when a vehicle is newly titled — not on renewals.
- Registration: $50.75 base, plus $13.25 in mandatory statewide fees (insurance verification, processing, and the inspection-replacement fee that took over when Texas dropped its annual safety inspection sticker in 2025).
